You may or may not need a work permit, depending on your work in Canada.
Canada has long valued immigration to meet its growing labour needs. If you plan to work in Canada, you will likely require a work permit, and Canada has over 100 different work permit pathways. Discover the right path for you.
We can help. We routinely help workers apply for a work permit or renew their work permit under the following programs: Provincial Nominee Program, Temporary Foreign Worker Program, Express Entry Program, and Canadian Experience Class.
However, increased government regulations and ever-changing rules can make the immigration process challenging.
Work permits are usually required for foreign workers who want to work in Canada temporarily.
A temporary work permit is often considered a step toward permanent residence. Many Temporary Foreign Workers (TFWs) in Canada apply for permanent resident status after a specific time under one of the Express Entry streams.
If you are a worker looking for assistance in applying to work in Canada or are looking to renew your application, we can help.
Canada offers Open Work Permits to only those who are eligible to apply.
An open work permit is precisely as it sounds. The holder of an Open Work Permit is allowed to work for any Canadian employer without requiring an employment contract with a positive LMIA. An open work permit does not have to be linked to a specific job, employer or location to work in Canada.
The officer may issue two types of Open Work Permits, which will be designated with or without occupational restrictions. An ‘unrestricted’ open work permit is generally used for applicants who have passed the medical examination and allows them to work in any occupation. About ‘restricted’ open work permits, this is for careers involving public health reasons, whereby the applicant did not pass the medical exam or has a medical condition.
Several factors make a Foreign National eligible to apply for an Open Work Permit. Persons already working in Canada and receiving a positive, permanent resident assessment under FSW, CEC, PNP, FST or H&C programs may be eligible to apply. There are many other scenarios whereby family members, spouses and common-law partners, home caregivers, refugees, international students, professional athletes and family members of military personnel may also be eligible to apply.
On-Track Immigration and Appeals will help you secure your Canadian open work permit if you qualify.
The Canada-United States- Mexico Agreement (CUSMA) has made it much easier for citizens of the United States and Mexico to work in Canada.
For now, American and Mexican citizens gain temporary entry into Canada to conduct business or investment activities.
Most other Canadian work permits need a “Labour Market Impact Assessment,” known as a “LIMA.”
This is the significant advantage of CUSMA, whereby a LIMA is not required.
If the employee qualifies for a CUSMA work permit, the application process can be completed in just a few days, compared with other work permits.
These four categories of business people benefit from the CUSMA provisions: business visitors, professionals, intra-company transferees, and traders and investors. CUSMA is also a great pathway to permanent residence in Canada.
They also exempt business visitors from obtaining a work permit to conduct business activities in Canada, provided specific requirements are met.
Professionals, intra-company transferees, traders, and investors will still require work permits.
We can help the employer and the employee with every step of the CUSMA application process.
The Government of Canada knows that not every employer treats their migrant worker or employee with the respect they deserve. When someone is working in a different country other than their own, they may not know their rights, or even if they do know their rights, they may feel intimated to state those rights.
You are entitled to be safe and free from abuse and all forms of harassment, including but not limited to: sexual and physical abuse, not being compensated for work completed, threats or passport / personal identification seizures.
Knowing that Canada has your back may give you the courage to leave an abusive situation. The Open Work Permit for Vulnerable Workers (OWPVW) is temporary but gives you enough time to search for and obtain new employment and apply for a new work permit. There is no Government fee to apply.
If you are in an abusive employment situation and need to be safe from an employer, please get in touch with us for help.
